Agreement to Terms
These Terms of Service govern access to and use of DEFYR, including the DEFYR mobile app, website, subscriptions, content, reminders, widgets, wallpapers, assessments, and related features. DEFYR is provided by JHRZ, LLC, a Nebraska limited liability company, operating under the DEFYR brand ("JHRZ," "we," "us," "our," or "DEFYR"). By downloading, accessing, subscribing to, or using DEFYR, each user agrees to these Terms. A user who does not agree should not use DEFYR.
Subscriptions
DEFYR may offer paid subscriptions that unlock premium content, features, wallpapers, widgets, reminders, assessments, or other app functionality. Available subscription plans, prices, trial periods, promotional offers, and included features are shown in the app or on the App Store before purchase. Subscription terms displayed at checkout control the specific subscription purchased.
Automatic Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Users can manage, change, or cancel subscriptions through Apple ID Account Settings or the App Store subscription management tools. Deleting the app does not cancel an active subscription.
Apple Billing and Refunds
Purchases are billed by Apple through the user's Apple ID. Apple handles payment processing, renewal notices, cancellation tools, refunds, taxes, and billing support according to Apple's policies. DEFYR does not control Apple's billing systems, does not receive full payment card information, and cannot guarantee that Apple will issue a refund.
App Store Terms
Use of DEFYR may also be subject to Apple's App Store terms, Apple Media Services terms, and any other terms presented by Apple. If there is a conflict between these Terms and Apple's terms for billing, subscription management, cancellation, or refunds, Apple's terms control those Apple services.
Intellectual Property
DEFYR, including its app design, branding, text, graphics, wallpapers, software, features, and other content, is owned by JHRZ, LLC or its licensors and is protected by intellectual property laws. You may use DEFYR only for personal, non-commercial purposes in accordance with these Terms.
Acceptable Use
- Do not copy, modify, reverse engineer, or resell DEFYR.
- Do not interfere with the operation, security, or integrity of DEFYR.
- Do not attempt to bypass subscriptions, entitlements, or access controls.
- Do not use DEFYR for unlawful, harmful, abusive, or fraudulent activity.
- Do not submit support messages or feedback that infringes others' rights.
No Guarantees
DEFYR does not guarantee any specific personal, professional, fitness, or lifestyle outcome. Use of DEFYR is at each user's own discretion and risk.
Educational and Motivational Use
DEFYR is intended for motivation, habit building, and personal development. It is not a medical, mental health, psychological, or therapeutic service and should not be relied upon as professional advice. Users are responsible for their own decisions, actions, and results, including whether to seek advice from qualified professionals.
User Communications
Feedback, support messages, or other communications submitted to DEFYR may be used to respond to requests, improve the app, troubleshoot issues, and protect the service. Users are responsible for ensuring submitted content is lawful and does not infringe another person's rights.
Third-Party Services
DEFYR may rely on third-party platforms and service providers, including Apple and subscription, analytics, attribution, hosting, diagnostics, and communication providers. Third-party services are governed by their own terms and policies. JHRZ is not responsible for third-party systems outside its control.
Availability and Changes to DEFYR
JHRZ may update, modify, suspend, or discontinue any part of DEFYR at any time, including content, features, prices, offers, and subscriptions, subject to applicable law and Apple requirements.
Limitation of Liability
To the fullest extent permitted by law, JHRZ, LLC and its owners, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, or device issues arising from or related to use of DEFYR.
Termination
JHRZ may suspend or terminate access to DEFYR if a user violates these Terms, misuses the app, creates risk for other users or the service, or if all or part of DEFYR is discontinued. Users may stop using DEFYR at any time. Subscription cancellation must be handled through Apple ID Account Settings or App Store subscription management tools.
Changes to These Terms
JHRZ may update these Terms from time to time. If changes are material, DEFYR may provide additional notice where required. Continued use of DEFYR after updated Terms become effective means the revised Terms have been accepted.
